Terms of Service

These Terms of Service ("Terms") govern your access to and use of the GannChart.ai website (gannchart.ai), the application (app.gannchart.ai), and any related services (collectively, the "Service"). By creating an account, starting a trial, or paying for a subscription, you agree to these Terms.

1.Acceptance of Terms

By accessing or using the Service you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

You must be at least 18 years old, or the legal age of majority in your jurisdiction, whichever is greater. By using the Service you represent and warrant that you meet this requirement.

2.The Service

GannChart.ai provides charting tools, planetary line calculations, Square of Nine and other Gann methodology utilities, AI-generated market briefings, alert delivery (email, Telegram), and related features. The exact features available depend on your subscription tier as shown at gannchart.ai/#pricing.

We continuously develop and may add, modify, or remove features. Material removals affecting your tier will be announced at least 30 days in advance.

3.Account & Eligibility

To use most features you must create an account. You agree to provide accurate information, keep your password secure, and notify us immediately of any unauthorized access. You are responsible for all activity under your account.

One account per individual. Sharing accounts, reselling access, or operating an account on behalf of multiple traders without an explicit team subscription is prohibited.

4.Subscription, Billing & Trial

Free trial

We may offer a free trial period (typically 14 days) at the start of your subscription. You provide payment details when starting the trial. If you do not cancel before the trial ends, your subscription will automatically continue at the rate of your selected plan and your payment method will be charged.

Recurring billing

Subscriptions are sold on a recurring basis (monthly or annual, depending on the plan you select). Your payment method will be automatically charged at the start of each billing cycle until you cancel. Pricing is shown at the time of signup and on our pricing page; we reserve the right to change pricing for new signups, but existing subscribers will receive at least 30 days' notice before any price increase affecting them.

Payment processing

All payments are processed by Stripe. By providing payment details you authorize Stripe to charge your card or other payment instrument on our behalf. We do not store full card numbers; Stripe handles card data under PCI-DSS standards.

Taxes

Stated prices are exclusive of any applicable taxes (VAT, sales tax) unless explicitly noted. Where required by law, applicable taxes will be added at checkout.

5.Cancellation & Refunds

You can cancel your subscription at any time from your account settings or by emailing support@gannchart.ai. Cancellation takes effect at the end of your current billing period — you retain access for the time you have already paid for.

Refund policy: the free trial period gives you ample opportunity to evaluate the Service. After a paid period has begun, fees are non-refundable except where required by applicable law. We may, at our sole discretion, offer pro-rated refunds in cases of extended Service outage or billing error.

Chargebacks and disputed payments may result in immediate account suspension pending resolution.

6.Acceptable Use

You agree not to:

• Reverse-engineer, decompile, or attempt to extract the source code of the Service.
• Scrape, crawl, or systematically download data from the Service except as expressly permitted.
• Resell, sublicense, or redistribute the Service or its outputs as a paid product.
• Use the Service to violate any law, infringe intellectual property, or harm other users.
• Attempt to bypass authentication, billing, or rate limits.
• Upload malicious code, attempt unauthorized access, or interfere with the Service's operation.
• Use the Service to provide automated trading signals to third parties unless you hold an explicit reseller or API license from us.

7.Intellectual Property

The Service, including its software, design, content, calculations, AI-generated outputs, and brand, is owned by GannChart.ai and protected by copyright and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal trading research while your subscription is active.

Charts, screenshots, and analyses you generate using the Service belong to you. You retain the right to publish them publicly with attribution to GannChart.ai. You may not, however, claim the underlying calculations or methodology as your own work.

9.Limitation of Liability

To the maximum extent permitted by law, in no event shall GannChart.ai, its affiliates, employees, or contractors be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost trading opportunities, lost data, or business interruption, arising out of or in connection with your use of the Service — even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the 12 months immediately preceding the event giving rise to the claim, or (b) USD $100.

Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions the limitations above apply only to the extent permitted by law.

10.Indemnification

You agree to indemnify and hold GannChart.ai harmless from any claim, loss, or demand (including reasonable attorneys' fees) arising out of your use of the Service in violation of these Terms or applicable law.

11.Termination

You may terminate your account at any time by cancelling your subscription. We may suspend or terminate your account, with or without notice, if you breach these Terms, engage in fraudulent activity, charge back a payment, or use the Service in a way that harms other users or the operation of the Service. Upon termination your right to use the Service ends immediately; sections that by their nature should survive (intellectual property, disclaimers, limitations of liability, indemnification, governing law) will survive.

12.Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by email and on this page at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service and cancel your subscription before they take effect.

13.Governing Law & Disputes

These Terms are governed by the laws applicable to the principal place of business of GannChart.ai, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service shall first be addressed by good-faith negotiation. If unresolved within 60 days, disputes shall be submitted to binding arbitration or to the competent courts of that jurisdiction, at our election.

You agree that any claim must be brought individually and not as a plaintiff or class member in any class or representative proceeding, except where prohibited by applicable law.
